Terms of Service & Privacy Policy
These Terms of Service ("Terms") are a legally binding agreement between you and Scholarwave Crimson Ventures ("Scholarwave", "we", "us", "our") governing your access to and use of the Scholarwave website and Student Portal, the Scholarwave Admin Portal mobile application, and the Scholarwave Windows desktop application (together, the "Service").
By registering a school, signing in as a student, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
"Service" refers to the Scholarwave website and Student Portal, the Admin Portal mobile application, and the Windows desktop application, and all related features — including dashboard analytics, teacher and student management, quiz and exam creation, AI-powered content generation, assignments and homework, study notes, performance reports, subscription management, and school configuration settings.
"Content" refers to any quizzes, exams, questions, assignments, study notes, reports, analytics data, or other materials created, generated, uploaded, submitted, or managed through the Service.
"AI-Generated Content" refers to any educational material produced using the Service's artificial intelligence features, including the AI Converter tool.
2. Eligibility and Accounts
- School administrators and teachers must be authorized to act on behalf of their school and are responsible for providing accurate registration information and maintaining their account and login credentials. You must notify us immediately of any unauthorized use of your account.
- Students access the Student Portal using a code issued by their school — no separate account or password is created. Students and, where applicable, their parents or guardians are responsible for keeping this code confidential.
- We reserve the right to suspend or terminate access that violates these Terms or engages in suspicious activity.
3. Use of AI-Generated Content
- The Service uses artificial intelligence to help generate educational content, including quiz and exam questions. AI-generated content is provided on an "AS IS" basis.
- AI can and does make mistakes. We do not warrant the accuracy, correctness, completeness, or pedagogical suitability of any AI-generated content.
- Teachers are solely responsible for reviewing, verifying, and approving AI-generated content before it is deployed to students or used in any formal assessment.
- We bear no responsibility for consequences arising from unverified or unedited AI-generated content, including incorrect grading or misleading information.
4. Examination Integrity
Scholarwave provides the platform for creating and conducting examinations, including anti-cheat measures such as tab-switch detection on the Student Portal and kiosk-mode window locking on the desktop app. While we implement these safeguards, the school remains responsible for supervising candidates and preventing academic malpractice. Offline autosave and local caching features are provided to help exam answers survive a dropped connection, refresh, or power interruption, but do not guarantee complete data recovery in every circumstance.
5. Subscription and Payment
- Certain features require an active school subscription. Subscription plans, seat limits, and pricing are as presented within the Service.
- Payments are processed through third-party payment providers (including Paystack). We are not responsible for errors, delays, or issues arising from third-party payment processing.
- If a school exceeds its registered student cap, further student sign-ins may be locked until the subscription tier is upgraded.
- Subscriptions may auto-renew unless cancelled before the renewal date. Refund requests are reviewed on a case-by-case basis.
6. Acceptable Use
You agree to use the Service solely for lawful educational and administrative purposes. You must not:
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our servers and systems;
- Use the Service to store, transmit, or distribute malicious software or unlawful content;
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Share administrative credentials or student sign-in codes with unauthorized individuals;
- Reproduce, distribute, or commercially exploit the Service or content generated through it without our prior written consent.
7. Intellectual Property
All rights, title, and interest in the Service — including its source code, design, branding, and proprietary algorithms — remain the exclusive property of Scholarwave Crimson Ventures. Content your school creates or uploads remains your property; by using the Service, you grant us a limited, non-exclusive license to process and store it as necessary to provide the Service.
8. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free access. We may modify, update, or discontinue features at any time, with or without notice.
9. Limitation of Liability
To the maximum extent permitted by law, Scholarwave Crimson Ventures, its directors, employees, and affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of data, reliance on AI-generated content, or interruption of the Service caused by local network failures or power outages. Our total liability shall not exceed the amount paid for the Service in the twelve (12) months preceding a claim.
10. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access without prior notice if these Terms are violated. Provisions relating to intellectual property, limitation of liability, and disclaimers survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after such changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
Privacy Policy
We are committed to protecting the privacy of school staff, students, and parents whose data is handled through the Service.
What We Collect
- School and staff data: school name, administrator and teacher accounts, and subscription/billing details.
- Student data: name, class, sign-in code, exam and assignment answers, scores, and uploaded report cards — entered by the school, not by the student directly.
- Technical data: basic session information needed to keep a student signed in and to resume an in-progress exam (stored locally in the student's browser, not on our servers).
How We Use It
Student and school data is used solely to operate the Service: authenticating sign-ins, grading and storing exam and assignment results, generating report cards, and displaying study notes. We do not sell student or school data, and we do not use it for advertising.
Who Can See It
Each school's data is isolated from every other school. Students can only see their own results, assignments, and study notes. Teachers and administrators can only see data belonging to their own school. Data is stored with Supabase, our database provider, under access controls (Row Level Security) scoped per school.
Data Retention and Deletion
School administrators can back up and delete locally recorded results by date range or in full from within the app. To request deletion of a school's data from our servers, contact us using the details below.
Security
We use industry-standard security measures, including encrypted storage for sensitive credentials and per-school data isolation. No system is entirely immune to security incidents, and we cannot guarantee absolute security.
Children's Data
The Student Portal is used by school-age students under the direction of their school. Schools are responsible for obtaining any parental consent required by their local regulations before enrolling a student. We do not knowingly collect data directly from children outside of this school-supervised context.
Your Choices
Because student accounts are created and managed by the school (not self-registered), requests to access, correct, or delete a student's data should go through the school first. Schools or individuals may also contact us directly using the details below.
